Seller and Scope of These Terms

This online store operates under the trading name Wood Magic Goods.

The seller of the products and the party to all sales contracts concluded through this store is:

The business is registered in the Polish Central Register and Information on Economic Activity (Centralna Ewidencja i Informacja o Działalności Gospodarczej — CEIDG), maintained by the minister responsible for economic affairs.

In these Terms, “Wood Magic Goods”, “we”, “us”, “our” and “Seller” refer to the business identified above.

These Terms govern the use of the website, the electronic services available through the store, the placement of orders and the conclusion of sales contracts.

The online store is technically hosted by Shopify. When visitors access the store or make a purchase, Shopify processes certain information to provide and improve the store services, including services based on interactions with Shopify and other merchants. Information may be shared with Shopify and necessary third-party service providers located in other countries as described in our Privacy Policy.

These Terms are available free of charge and may be saved, downloaded or printed at any time.

The language of the store and of contracts concluded through the store is English.

Mandatory provisions of applicable law take precedence over any conflicting provision of these Terms.

Electronic Services and Technical Requirements

The following electronic services may be provided through the store free of charge:

  • browsing the product catalogue and product information
  • using the shopping cart
  • placing an order
  • contacting us through available forms or contact details
  • using a customer account, where this feature is available
  • subscribing to marketing emails or a newsletter, where this feature is offered

A contract for a one-time electronic service begins when the customer starts using the relevant function and ends when that function has been completed or the customer stops using it.

A customer account service begins when the account is created and continues until the account is deleted. A customer may request deletion of an account by contacting support.wmg@gmail.com.

A newsletter or marketing email service begins when the customer subscribes and continues until the customer unsubscribes. The customer may unsubscribe at any time by using the unsubscribe link contained in the message or by contacting us.

To use the store, the customer requires:

  • a device with internet access
  • an up-to-date web browser supporting JavaScript and cookies
  • a valid email address when placing an order or creating an account

Users must not:

  • provide or transmit unlawful content
  • interfere with the operation or security of the website
  • introduce viruses, malicious code or other harmful material
  • attempt to gain unauthorised access to systems or data
  • use false information or impersonate another person
  • circumvent technical or security restrictions
  • automatically extract website content by bypassing technical restrictions
  • use the store for unlawful or fraudulent purposes

We may restrict or suspend access to electronic services where necessary to protect the store, other users or third parties, or where a user materially violates these Terms or applicable law.

Complaints concerning the operation of the website or its electronic services may be sent to support.wmg@gmail.com.

The complaint should describe the issue and, where possible, identify the device, browser and date on which the issue occurred.

We will respond to complaints concerning electronic services within 14 days of receiving them.

Customers and Order Information

An order may be placed only by a person who is at least 18 years old and has the legal capacity required to enter into a contract.

The customer must provide accurate and current:

  • personal or business details
  • billing and shipping addresses
  • email address
  • telephone number
  • payment information

The customer confirms that they are authorised to use the selected payment method.

Before submitting an order, the customer must verify the selected product, dimensions, wood finish, upholstery colour, quantity, shipping address and total price.

Products and Handcrafted Characteristics

We take reasonable steps to ensure that product descriptions, photographs, dimensions, materials, included components and available options are accurate.

Customers acknowledge that:

  • wood is a natural material
  • wood grain, knots, texture and tone may vary
  • handcrafting may result in minor differences between individual products
  • colours displayed on a screen may vary due to lighting and device settings

Natural characteristics and minor production variations are not defects in themselves where they do not affect the safety, functionality, durability or agreed characteristics of the product.

Most products are manufactured or finally prepared after the order is placed. Available options and estimated production times are stated on the relevant product page.

Before placing an order, the customer must review the product dimensions and confirm that the product is suitable for the intended space, installation and use.

Orders and Formation of the Sales Contract

Product listings on the website constitute an invitation to place an order and are not, by themselves, a binding offer by the Seller.

By submitting an order through a button that clearly indicates an obligation to pay, the customer makes a binding offer to purchase the selected product under the conditions displayed during checkout.

An automated message acknowledging receipt of an order does not by itself constitute acceptance unless it expressly confirms that the order has been accepted.

The sales contract is concluded when we send the customer an email expressly confirming that the order has been accepted for processing.

The version of these Terms and the other policies in force at the time the order is accepted applies to that sales contract.

After the contract is concluded, we provide confirmation of the contract and the legally required information on a durable medium, normally by email.

Before accepting an order, we may decline it where there is an objective reason, including:

  • unavailability of necessary materials
  • inability to deliver to the specified address
  • a legal restriction affecting the product or delivery
  • failed or reversed payment
  • a reasonable suspicion of fraud or unauthorised payment
  • an obvious technical error in the price or product information

Where payment has already been received for an order that we do not accept, the payment will be refunded without undue delay.

If, after acceptance, performance of the contract becomes impossible due to circumstances outside our reasonable control, we will inform the customer without undue delay and refund any payment relating to the part of the contract that cannot be performed.

This does not limit any other mandatory rights available to the customer.

Changes to an accepted order are possible only with our agreement and depend on the stage of production. A requested change may affect the price and production time.

Prices, Taxes and Payment

The product price, taxes charged by the store, shipping costs and the total amount payable are displayed before the customer submits the order.

Prices may change before an order is placed. A price change does not affect an order that has already been accepted.

For international deliveries, the customer may be required to pay import duties, local taxes, customs charges or brokerage fees where those amounts were not expressly included during checkout.

Such charges may be imposed by authorities, customs agents or carriers in the destination country and are outside our control.

We do not declare a lower product value in customs documents and do not describe a commercial order as a gift.

Payments may be processed by independent payment providers. We do not receive the customer’s full payment card number.

Production, Shipping and Risk of Damage

Estimated production and delivery times are stated on the product page and in the Shipping Policy.

The production period begins after the order has been accepted and payment has been successfully received.

The transit period begins when the completed product is handed to the carrier.

Delivery times are estimates unless a specific delivery date has been expressly confirmed by us as binding.

We are not responsible for a delay directly caused by circumstances outside our reasonable control, including customs procedures, carrier restrictions, border closures, natural disasters, strikes or government restrictions.

This does not prevent a consumer from requiring performance, setting an additional reasonable period for delivery or terminating the contract where such a right is provided by mandatory law.

Where we arrange delivery, the risk of accidental loss of or damage to the product passes to the customer when the customer, or a third party designated by the customer other than the carrier, physically receives the product.

Where the customer independently appoints a carrier that was not offered by us, the transfer of risk is determined by applicable law.

Cancellation, Withdrawal, Returns and Complaints

Detailed rules concerning order cancellation, withdrawal from a distance contract, product returns and refunds are contained in the Return & Refund Policy.

Whether a statutory exception for a product made to the customer’s specifications or clearly personalised applies depends on the characteristics of the individual order and mandatory applicable law.

Nothing in these Terms or any other store policy limits the customer’s mandatory rights relating to a product that:

  • was damaged during delivery
  • has a manufacturing defect
  • does not match its description or agreed configuration
  • does not conform to the sales contract

The complaint should, where possible, include the order number, a description of the issue and photographs or video showing the problem.

The absence of photographs or video does not by itself prevent a consumer from making a valid complaint.

We will respond to a consumer complaint within 14 days of receiving it. The response will be provided on paper or another durable medium.

Depending on the circumstances and applicable law, the available remedies may include repair, replacement, price reduction or refund.

Assembly, Installation and Use

Some products are delivered unassembled and require assembly or installation.

The customer must:

  • read the instructions before assembly or installation
  • use the supplied or specified fasteners correctly
  • securely tighten and inspect all connections
  • install the product on a suitable surface
  • follow all stated limitations and care instructions
  • stop using the product if damage, instability or loosened connections are discovered

Where a product is intended to be fixed to a wall, the appropriate installation method depends on the wall material and the expected load.

Where the customer does not have the necessary knowledge or experience, installation should be carried out by a qualified professional.

To the fullest extent permitted by law, we are not responsible for damage caused exclusively by:

  • incorrect assembly or installation
  • use contrary to the supplied instructions
  • exceeding stated limitations
  • unauthorised modification of the product
  • improper care
  • continued use after damage has been identified
  • normal wear and tear

This limitation does not apply where the damage results from a manufacturing defect, incorrect or inadequate instructions, lack of conformity with the contract or another matter for which the Seller is legally responsible.

Liability for Commercial Orders

This section applies only to customers purchasing directly for professional or commercial purposes who are not entitled to consumer rights or to consumer-like protection granted to certain sole traders under mandatory Polish law.

To the fullest extent permitted by law, we are not liable to such a customer for:

  • indirect or consequential loss
  • loss of profit
  • loss of revenue
  • loss of business opportunity

Our total contractual liability to such a customer is limited to the amount actually paid for the product to which the claim relates.

This limitation does not apply to intentionally caused damage or where limitation of liability is otherwise prohibited by law.

Intellectual Property

Photographs, videos, texts, product descriptions, instructions, graphics, logos and the design of the store are owned by Serwis-Pro Andrii Kotok, trading as Wood Magic Goods, or are lawfully licensed to us.

Purchasing a product does not transfer any copyright, design rights, rights to photographs, website content or other intellectual property rights to the customer.

Without our prior written consent, users must not:

  • commercially copy or publish store materials
  • use our photographs or descriptions to sell other products
  • reproduce substantial parts of the website
  • create a false impression of an official relationship with Wood Magic Goods
  • use Wood Magic Goods names or branding in a way that infringes our rights

Personal Data and Third-Party Providers

Personal data is processed in accordance with our Privacy Policy.

Payment providers, carriers and other necessary service providers may process information to operate the store, receive payments, prevent fraud and fulfil deliveries.

Changes, Applicable Law and Disputes

We may update these Terms where reasonably necessary due to changes in law, store functions, payment methods, shipping arrangements or Seller information.

A new version applies from the date it is published and does not retrospectively change contracts already concluded, unless required by law or expressly agreed with the customer.

Where a material change affects an ongoing electronic service, registered users will be informed in advance where reasonably possible and may terminate that service before the change takes effect.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in effect.

These Terms and sales contracts are governed by Polish law.

Where the customer is a consumer, the choice of Polish law does not deprive the customer of mandatory protection granted by the law of the country in which the customer habitually resides, where that protection applies to the contract.

Disputes are determined by the court having jurisdiction under applicable law.

A consumer is not required to bring proceedings exclusively before a court located at the Seller’s place of business where such a restriction is prohibited by law.

Before starting court proceedings, the customer may contact us so that the parties can attempt to resolve the matter directly.
